By purchasing any program from Regain Mens Pelvic Health, you agree to be bound by these Terms of Service and Waiver. Please read carefully before completing your purchase.
1. Nature of Services
Regain Mens Pelvic Health, operated by Jongmoon Kwak, PT, DPT, FAAOMPT, OCS, provides online group wellness education classes for men recovering from prostatectomy surgery. These classes focus on pelvic floor exercise education and urinary incontinence management.
Important: These are wellness education classes — NOT individual physical therapy treatment, medical advice, diagnosis, or a substitute for care from your physician, urologist, or licensed healthcare provider.
2. Health Acknowledgment & Medical Clearance
By purchasing this program, you confirm that:
- You have consulted with your physician or urologist and are medically cleared to participate in pelvic floor exercise education
- You understand that exercises taught in these classes may not be appropriate for all individuals
- You will immediately stop any exercise that causes pain or discomfort and consult your physician before continuing
- You are 18 years of age or older
3. Assumption of Risk
You voluntarily assume all risks associated with participation in wellness education classes, including but not limited to physical discomfort during exercises, adverse reactions to exercise instruction, or technology-related interruptions. Regain Mens Pelvic Health and Jongmoon Kwak, PT, DPT, FAAOMPT, OCS shall not be liable for any injury, loss, or damage arising from your participation.
4. Release of Liability
To the fullest extent permitted by California law, you hereby release, waive, and discharge Regain Mens Pelvic Health, Jongmoon Kwak, PT, DPT, FAAOMPT, OCS, and their successors and assigns from any and all claims, demands, actions, or causes of action arising out of or related to your participation in this program, whether caused by negligence or otherwise.
5. Payment Terms
All fees are due in full at the time of booking. This is a strictly cash-based practice. We do not accept, bill, or submit claims to health insurance, Medicare, Medicaid, or any third-party payer. You are solely responsible for all payment. Payments are processed securely through Stripe.
6. Refund & Cancellation Policy
- Individual classes: Rescheduling permitted with 48 hours notice at no charge. No refund for missed classes without 48-hour notice.
- Bundles: Non-refundable once any class in the bundle has been attended. Unused sessions valid for 12 months from purchase.
- Monthly Membership: Cancel before the next billing cycle with no penalty. No partial month refunds.
- Extenuating circumstances: Contact [email protected] — we review on a case-by-case basis.
7. No Insurance Reimbursement
These wellness education classes are NOT billable to any health insurance plan, Medicare, Medicaid, or third-party payer. We do not provide superbills or any documentation for insurance reimbursement. All fees are private pay only.
8. Telehealth Acknowledgment
All sessions are conducted online via video. By purchasing, you acknowledge that you have read and agree to our Telehealth Informed Consent. You understand the technology requirements, limitations, and emergency protocol described therein.
9. Confidentiality & Group Sessions
Group wellness sessions are conducted with other participants. By participating, you agree to respect the privacy of all other group members and not to record, share, or disclose information about other participants. All educational materials are the intellectual property of Regain Mens Pelvic Health and may not be recorded or redistributed.
10. Governing Law
This Agreement is governed by the laws of the State of California. Any disputes shall be resolved in Contra Costa County, California. If any provision is found unenforceable, the remaining provisions remain in full force.
